Privacy Notice Introduction

This privacy notice explains how your personally identifiable information will be used on this Moodle Learning Management System (“Moodle LMS”) that as been developed in collaboration with University Hospitals Birmingham NHS Foundation Trust (“UHB”) and Synergy Learning (“Synergy Learning”) specifically to respond to the COVID-19 pandemic crisis . Personally identifiable information can be used on its own or with other information to identify a living individual. Your personally identifiable information is stored, used and accessed in accordance with the General Data Protection Act (“GDPR”) and UK Data Protection Act 2018. Under data protection law we are legally required to provide information about how we use your information in a way that is:

  • concise
  • transparent
  • easy to understand
  • easily accessible
  • written in clear, plain language, particularly if addressed to a child
  • free of charge

Data protection law says that personal information we hold on you must be:

  1. used lawfully, fairly and in a transparent way
  2. collected only for valid purposes that we have clearly explained to you and not used in any way that is incompatible with those purposes
  3. relevant to the purposes we have told you about and limited only to those purposes
  4. accurate and kept up to date
  5. kept only as long as is necessary for the purposes we have told you about
  6. kept securely

What personal information do we collect at registration?

When you first register onto this Moodle LMS, you will be asked to enter your First Name, Surname and email address before creating your username and password. You may be asked for the work stream you are involved with so that the Moodle LMS can provide the relevant learning resources to your role.


Why do we collect this information?

We collect this information to provide designated individuals with access to the relevant learning materials related to COVID-19 response activities. Synergy Learning only collects and holds this information on the Moodle LMS to help you with your learning account such as logging in, highlighting relevant educational content, linking previous training activities, and recovering your password.


How do we use this information?

This information is held securely with Synergy Learning  and we use it in the management of your online learning account. We do not share your personal information with any third party organisation unless mandated to by legal requirements nor do we use it to market any additional services to you beyond the purposes of the Moodle LMS.  The content and the Moodle LMS platform have been developed  to provide a skills and training resource to address the public health challenges resulting from the COVID-19 pandemic. The legal basis for processing your information is therefore under GDPR article 6.1 (e) “processing is necessary for the performance of a task carried out in the public interest”.


How do I access, amend or delete my information?

Contact details are provided at the bottom of this notice should you wish to access, amend or delete your information on the learning management system as per your rights under the GDPR Articles 12 through to 23.


What further information do we collect as you use the learning management system?

When you use the Moodle LMS we may send one or more small text files containing a string of alphanumeric characters (“cookies”) to your device. Some cookies disappear when you close your browser, but others may persist on your device after you close your browser and may be used on subsequent visits to the Moodle LMS, such as to remember your preferences. More information on cookies can be obtained from allaboutcookies.org which provides resources and on cookie usage and how to disable them.

We may also automatically record certain information from your device by using various types of technology. This automatically collected information may include your IP address or other device address or ID, web browser and/or device type, the web pages or sites that you visit just before or just after you use the Service, the pages or other content you view or otherwise interact with on the Service, and the dates and times that you visit, access, or use the Service. We also may use these technologies to collect information regarding your interaction with email messages, such as whether you opened, clicked on, or forwarded a message. In addition, we may obtain information about your physical location, such as geolocation features in your device, or by inference from other information we collect (for example, your IP address indicates the general geographic region from which you are connecting to the internet).

Synergy Learning use information from Cookies to analyse and improve their service, including by assessing how many users access or use their service, which content, products, and features of their service most interest our visitors, what types of offers our customers like to see, and how their service performs from a technical point of view.

Synergy Learning may use website and application analytics service provided by third parties that use cookies and other similar technologies to collect information about website or application use, report trends and target marketing messaging. These third parties include Google Analytics and Lead Forensics. Children’s Privacy

The Moodle LMS is a general audience site not directed to children under the age of 16, and we do not knowingly collect personally identifiable information from children under the age of 16 without parental consent. If you are under 16 years of age, then please do not use or access the Moodle LMS at any time or in any manner. If we learn that personally identifiable information has been collected on the Moodle LMS from a child under 16 years of age without parental consent, then we will take appropriate steps to delete this information. If you are a parent or guardian and discover that your child under 16 years of age has obtained an on the Moodle LMS, then you may alert us at informationgovernance@uhb.nhs.uk and request that we delete that child’s personally identifiable information from the learning management system.


How do we protect your information?

Synergy Learning maintains administrative, technical and physical safeguards that are intended to appropriately protect personally identifiable information against accidental or unlawful destruction, accidental loss, unauthorised alteration, unauthorised disclosure or access, misuse, and any other unlawful form of processing of the personally identifiable information in our possession. We restrict access to personally identifiable information about you to those UHB and Synergy Learning employees who need to know that information to provide the learning management service to you. However, we cannot and do not guarantee that your information will not be accessed, viewed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

Additionally, we cannot control the actions of other users with whom you may choose to share your information. Further, even after information posted on the learning management system is removed, caching and archiving services may have saved that information, and other users or third parties may have copied or stored the information available. We also take measures to delete your personally identifiable information or keep it in a form that does not permit identifying you when this information is no longer necessary for the purposes for which we process it in the context of the Moodle LMS or when you request their deletion, unless we are required by law to keep the information for a longer period. We complete periodic reviews of our databases, and have established specific time limits for data deletion, taking into account the type of service provided, the length of the customer relationship, possible re-enrolment with the Moodle LMS, mandatory retention periods and the statute of limitations.


Third-Party Services  

Content on the Moodle LMS may contain  features or links to websites and services provided by third parties. Any information you provide on third-party sites or services is provided directly to the operators of such services and is subject to those operators’ policies, if any, governing privacy and security, even if accessed through the learning management system. We are not responsible for the content or privacy and security practices and policies of third-party sites or services to which the links or access are provided through the Moodle LMS. We encourage you learn about third parties’ privacy and security policies before providing them with information.
